How Did Hyderabad Finally Become a Part of Telangana?
Hyderabad city will not officially be designated the joint capital of Telangana and Andhra Pradesh on 2 June 2024. On 2 June 2014, Hyderabad was made the joint capital of Andhra Pradesh and the newly created Telangana state for ten years. Telangana was created as the 29th state of India by bifurcating Andhra Pradesh in 2014.
The state of Telangana was created by the Andhra Pradesh Reestablishment Act 2014 of Parliament under Division 3 of the Constitution. Under this Act, the capital of united Andhra Pradesh was given to Hyderabad, Telangana.
Section 5(1) of the Andhra Pradesh Reestablishment Act 2014 proposes that the two states will continue to have a common capital for a period of ten years beginning on 2 June 2014. 2019 Jagan Mohan Reddy’s government came to power in Andhra Pradesh. The Andhra Pradesh Decentralization and Inclusive Development of All Regions Act (APCRDA), 2014 was amended by the Andhra Pradesh Decentralization and Inclusive Development of All Regions Act, 2020.
It is proposed to make Visakhapatnam the executive capital of Andhra Pradesh, Amaravati the city capital, and Kurnool the state capital.
According to the government, the purpose of creating three separate capitals for the state is to develop multiple areas of the state and promote overall development.
High Court Decision
This machinery was challenged in the Andhra Pradesh High Court. In its judgment in 2022, the High Court declared it unconstitutional because the Andhra Pradesh Reestablishment Act 2014 provided for only one capital for Andhra Pradesh. The High Court ordered the government to develop Amaravati as a special capital within six months.
The Andhra Pradesh government has challenged the High Court decision in the Supreme Court and the case is sub judice.
